Abstract


The development of blockchain technology and the use of Non-Fungible Tokens (NFTs) have revolutionized the digital art market, providing artists with opportunities to monetize their work globally. However, with the ease of access and trade of digital artworks, serious issues related to copyright infringement have emerged, particularly in the form of plagiarism of artworks sold as NFTs. NFT plagiarism refers to the act of stealing or copying digital artworks that have been tokenized as NFTs and selling them without the permission of the rightful copyright owner. This phenomenon presents significant legal challenges due to the decentralized, anonymous, and global nature of NFT transactions, making law enforcement more difficult.This paper aims to examine the law enforcement mechanisms for NFT creators who experience plagiarism in Indonesia, while also exploring the barriers and solutions within both national and international legal contexts. The study identifies several key obstacles, including the lack of clear regulations governing NFT transactions, difficulties in proving copyright infringement in the digital realm, and the limited international enforcement mechanisms available to artists. In Indonesia, there is currently no regulation that explicitly addresses copyright protection in the context of NFTs, which makes it challenging for artists to assert their rights over works traded without their consent. As a solution, there is a need for updated regulations that are more adaptive to technological advancements, strengthened international cooperation in copyright enforcement, and more intensive education for artists and the public on the importance of protecting artistic works in the digital world.
